Touchpoints Terms of Service

1. Service Summary

Touchpoints is an open-source software application created and maintained by Civic Studio LLC. It enables organizations to collect feedback, model processes, and manage digital services.

2. Data Collection, Use, and Security

Data Storage and Access

Form submissions are stored in a database and accessible through:

• Real-time view in the application
• CSV export for download
• JSON API for programmatic access

Data Security

• Data encrypted via HTTPS during transit
• Data encrypted at rest in the database
• Users automatically logged out after 30 minutes of inactivity

Data Privacy

Organizations own the data they collect through Touchpoints. Civic Studio LLC will not access or disclose organization data except as required by law or as necessary to maintain the service. Data access is limited to the minimum number of individuals required to operate the platform.

3. Use of Touchpoints

Touchpoints provides feedback collection, process modeling, and service management tools for organizations seeking to understand and improve their services. Users must register with a valid email address to access the service.

4. Subscriptions and Billing

Touchpoints offers free and paid subscription plans. Paid subscriptions are billed monthly through Stripe.

• Subscriptions renew automatically each billing cycle.
• You may cancel at any time; access continues through the end of the current billing period.
• No refunds are provided for partial billing periods.
• Civic Studio LLC reserves the right to change pricing with 30 days notice.

5. Service Benefit

Touchpoints delivers several benefits to organizations:

• Reduces logistics burden of feedback collection
• Provides accessible, standards-compliant forms
• Enables process modeling and journey visualization
• Supports data-driven service improvement

6. Right to Limit

Civic Studio LLC reserves the right to limit or block access to Touchpoints at any time for any reason, including but not limited to maintenance, security concerns, or resource constraints.

7. Service Termination

Civic Studio LLC may terminate or discontinue Touchpoints at any time with reasonable notice to users. Organizations are responsible for exporting their data before service termination.

8. Changes

Civic Studio LLC may modify these Terms of Service at any time. Users will be notified of significant changes through the application or via email.

9. Disclaimer of Warranties

Touchpoints is provided "as is" and "as available" without warranties of any kind, either express or implied. Civic Studio LLC does not guarantee the service will be uninterrupted, secure, or error-free.

10. Limitations on Liability

Civic Studio LLC is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use Touchpoints.

11. General Representations

By using Touchpoints, organizations represent that:

• They have authority to collect customer feedback
• They will comply with all applicable laws and regulations
• They will not use the service for unauthorized purposes
• They will protect any sensitive information collected

12. Miscellaneous

These Terms of Service constitute the entire agreement between Civic Studio LLC and Touchpoints users. Any provisions found to be invalid or unenforceable will not affect the validity of the remaining provisions.

13. No Waiver of Rights

Civic Studio LLC's failure to enforce any provision of these Terms of Service does not constitute a waiver of that provision or any other provision.
